1. Introduction
Welcome to Siyaram Driving School. These Terms and Conditions govern your use of our website and services. By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement.
2. Services
Siyaram Driving School provides professional driving instruction and lessons in Melbourne's eastern suburbs. Our services include:
- Learner driving lessons
- Provisional driving lessons
- Drive test preparation
- Defensive driving courses
3. Lateness and Non-Attendance (No-shows)
A) Late Arrival
If you arrive late for a lesson, the instructor may only offer you the remaining lesson time if they have a commitment to another lesson immediately after. You will still be charged for the full lesson cost.
B) No-Show Policy
If you do not attend a lesson (No Show), we reserve the right to cancel the lesson at the instructor's reasonable discretion and charge the full lesson cost.
4. Payment and Packages
A) Package Payment
Packages must be paid in full at the time of booking or on the first lesson via cash or bank transfer.
B) Package Restrictions
Packages cannot be used in conjunction with any other promotion unless specifically stated.
C) Lesson Scheduling
Lesson schedules can be organised seven days a week, subject to instructor availability.
D) Refund Policy
Single lessons or packages are non-refundable and non-transferable unless agreed upon by Siyaram Driving School.
5. Lesson and Test Policy
A) First Lesson Assessment
The first lesson will always be an assessment lesson, allowing the instructor to evaluate the student's driving ability and readiness for a driving test.
B) Test Pass Guarantee
While we do not guarantee a test pass, we guarantee a high standard of professional teaching and training to equip students with the skills needed for a successful driving test.
C) License Requirements
All students must hold a valid Victorian Learner Permit or an original overseas licence with a certified English translation to qualify for any lessons.
6. Cancellation and Rescheduling
A) Notice Period
A minimum of 24 hours' notice must be given directly to your instructor for any rescheduling or cancellation of a lesson. Failure to do so will result in a full lesson fee being charged or deducted from your package.
B) Exceptional Circumstances
If a student is unwell or experiences an emergency, consideration will be given on a case-by-case basis at the discretion of Siyaram Driving School.
7. Vehicle and Instructor Availability
A) Instructor Assignment
Lesson bookings are subject to instructor availability. While we strive to maintain consistency, we may assign a different instructor if necessary.
B) Cancellation Due to Unforeseen Circumstances
Siyaram Driving School reserves the right to cancel or reschedule lessons due to unforeseen circumstances, including vehicle breakdowns or instructor illness. In such cases, we will provide as much notice as possible and arrange an alternative lesson time.
C) Extreme Weather and Emergencies
In the event of extreme weather conditions or emergencies (e.g., bushfires, floods), lessons may be rescheduled at the discretion of Siyaram Driving School. Safety will always be our priority.
8. Student Responsibilities
Students must:
- Possess a valid learner's permit or provisional license
- Arrive on time for scheduled lessons
- Follow all instructions from the instructor
- Comply with all traffic laws and regulations
- Treat the vehicle and equipment with care and respect
9. Instructor Responsibilities
Our instructors are qualified, licensed professionals who will:
- Provide professional and courteous service
- Ensure vehicle safety and maintenance
- Adapt teaching methods to individual student needs
- Maintain confidentiality of student information
10. Liability and Insurance
All vehicles used for lessons are fully insured. However, students are responsible for any damage caused by their negligence or deliberate actions. Siyaram Driving School is not liable for any personal injury or property damage resulting from student actions during lessons.
11. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Siyaram Driving School and protected by copyright laws. You may not reproduce, distribute, or transmit any content without our prior written permission.
12. Limitation of Liability
Siyaram Driving School shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or website.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts located in Victoria.
14. Changes to Terms
Siyaram Driving School reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website constitutes your acceptance of the modified terms.
15. Safety and Conduct
A) Following Directions
Students must follow the instructor's directions at all times and adhere to Victorian road rules.
B) Substance Abuse Policy
If a student is found to be under the influence of alcohol or drugs, the lesson will be immediately terminated, and the full lesson fee will be charged.
C) Inappropriate Behaviour
Any inappropriate, abusive, or dangerous behaviour towards the instructor, other road users, or pedestrians will result in immediate termination of the lesson without a refund.
D) Liability for Fines and Accidents
Siyaram Driving School is not responsible for any fines, penalties, or accidents that occur during lessons. The student is responsible for their own adherence to road rules and safe driving practices.
16. Driving Test Bookings
A) Test Booking Responsibility
The student is responsible for booking their VicRoads driving test unless otherwise arranged with Siyaram Driving School.
B) Vehicle Use for Test
If using a Siyaram Driving School vehicle for the test, additional fees may apply, and payment must be made prior to the test date.
C) Non-Attendance at Test
If the student fails to attend the test without adequate notice, any associated fees will be non-refundable.
D) VicRoads Test Cancellation
If VicRoads cancels the driving test for any reason, including but not limited to missing or expired identification documents, Siyaram Driving School is not responsible, and the fee will be non-refundable.
E) Test Failure
If the student fails the driving test, the fee is non-refundable.
17. Parental Consent for Minors
A) Consent Requirement
Students under the age of 18 must have parental or guardian consent before booking any lessons with Siyaram Driving School.
B) Guardian Acknowledgment
The parent or guardian must acknowledge and agree to all terms and conditions on behalf of the minor.
18. Refund Policy
A) Non-Refundable Payments
All payments for single lessons and packages are non-refundable and non-transferable unless otherwise agreed by Siyaram Driving School in exceptional circumstances.
B) Refund Request Process
Refund requests must be submitted in writing and will be assessed on a case-by-case basis at the discretion of Siyaram Driving School.
C) Non-Refundable Situations
Refunds will not be provided for change of mind, student's failure to attend lessons, or failing the driving test.
19. Agreement and Acknowledgment
By booking and attending lessons with Siyaram Driving School, you agree to the above terms and conditions. Siyaram Driving School reserves the right to update these terms at any time without prior notice.
20. First Time Pass Guarantee
Siyaram Driving School offers a First Time Pass Guarantee to eligible students. This guarantee assures that if you fail your first drive test, we will accept your second drive test free of instructor fees.
A) Guarantee Eligibility
The guarantee is only valid if the student/client has passed at least 2 mock tests with the Instructor.
B) Minimum Lesson Requirement
It is mandatory to take at least 10 driving lessons plus test package with our Instructor to be eligible for the guarantee.
C) Re-Test Timeline
The re-test should be within 8 weeks after the first failed attempt. Exemptions may be granted to this time limit by the Instructor at their discretion.
D) Guarantee Coverage
The guarantee will only cover the Instructor fees and not the VicRoads re-booking testing fees. Students are responsible for paying VicRoads fees for the re-test.
E) Second Attempt Lesson Policy
For the second attempt, no lesson will be provided before the test. The Instructor will meet you directly at the VicRoads testing centre 15 minutes prior to the actual drive test.
F) Maximum Guarantee Attempts
The guarantee is only valid for a maximum of 2 drive test attempts. If you fail both tests, the guarantee expires and no further free instructor fees will be provided.
